Next Friend Petitions Another alternative for seeking judicial review for and on behalf of a friend or relative incarcerated, by a third party known as 'next friend' to apply for a writ of habeas corpus on behalf of the incarcerated individual who pursuant to Whitmore v. Arkansas, 495 U. S. 149 has standing to litigate on behalf of a prisoner who for various reasons cannot apply for such themselves. Such standing can be a close friend or relative or by one who has been provided a Limited Power of Attorney granted to the 'next friend' as authorization to so serve. William Marshall can assist the 'next friend' in the preparation of a 'next friend' petition pursuant to Article III of the U. S. Constitution and as like authorized pursuant to 28 U. S. C. 2242. Fees for such service is similar to that which applies to providing legal support services to pro se litigants. |
